RESUMO

Por meio da presente pesquisa foram analisados os impactos da reforma trabalhista, em específico quanto a aplicação do pagamento das horas in itinere com a nova redação da lei, quando também foram abordados pontos pertinentes para a compreensão das mudanças proporcionadas pela reforma, seja no espaço ou no tempo. Quanto aos objetivos foram divididos em geral e específicos e, em noções gerais, foi analisada a motivação da reforma e o surgimento das horas in itinere e, em específico, foram pesquisadas as condições da possibilidade do pagamento das horas in itinere em virtude das alterações da CLT advindas pela Lei 13.467/2017. A problemática consistiu em identificar se ocorreu a flexibilização dos direitos trabalhistas e possibilidade do pagamento do tempo in itinere. Quanto à metodologia. A pesquisa é uma revisão bibliográfica do tipo qualitativa, cujo método de pesquisa foi o dedutivo.

ABSTRACT

The present study analyzed the impacts of the labor reform, on the specific application of the payment of hours in itinere with the new wording of the law, when were also approached points pertinent to the understanding of the changes provided by the reform, either in space or in the time. The objectives were divided in general and specific and, in general notions were analyzed the motivation of the reform and the appearance of hours in itinere, and in particular, were investigated the conditions of the possibility of payment of the hours in itinere by virtue of the changes of the CLT as reform. The problem was to identify whether flexibilization of labor rights occurred and the possibility of payment of time in itinere occurred due to other devices such as Complementary Law 123 of 2006. Regarding the methodology, the research is a bibliographic review of the qualitative type whose method of research was the deductive. Concluding that the payment of hours in itinere is a legacy of jurisprudence and that although the reform excludes the device of the CLT that disciplined it, there are other rules that are still in vogue and deal with the subject.
