ABSTRACT
In the present moment we are living the discussion about reducing the legal age for criminal responsibility has been gaining more space, bringing opinions in favor and against it. Nowadays in Brazil the legal age for criminal responsibility is eighteen years-old, however the history tells us that our legislation has come a long way until the present moment. During the work it notes that in the constitutional area the polemic is about the possibility of reducing the legal age for criminal responsibility considered by many as an ‘’entrenchment clause’’. But some scholars refute that idea and proposes that there is a possibility of change through constitutional amendment. Nevertheless, it notes an impunity feeling in the society which pursuits an answer from the legislators to take the necessary measures to the young people who falls in the world of the crime. Therefore to hold the young criminality is necessary to attack the causes, as a social problem that implicates social charges, before the state´s responsibility install and bear the public policies focused to the minors.
